Section Two - Ticket terms and conditions

1) In these terms and conditions, unless expressly stated otherwise:-

    1. "Ambush Marketing" means the unauthorised use of the Ticket as a prize or in a lottery or competition or for any other promotional, advertising or commercial purpose and/or any activity by a person not authorised by Management which (i) associates the person with the Tournament or (ii) exploits the publicity or goodwill of the Tournament or (iii) has the effect (in the reasonable opinion of Management) of diminishing the status of any Tournament Partner or conferring on the person the status of a Tournament Partner;
    2. "Applicant" means any person who applies for or purchases any Ticket/s in accordance with these Conditions;
    3. "Conditions" means the terms and conditions contained herein;
    4. "Guest" means any other person for and on whose behalf the Applicant may be purchasing any Ticket and to whom a Ticket may be transferred in accordance with these Conditions;
    5. The "Holder" means any or all of (i) the Applicant and/or (ii) a Guest and/or (iii) any person in possession of a Ticket and/or (iv) the person making use of a Ticket and/or (v) the person making payment for the Ticket and/or (vi) a person purchasing the Ticket;
    6. "Management" means (as the context requires) ICC Development (International) Ltd ("IDI") and/or England and Wales Cricket Board ("ECB") and/or the person/s responsible for the management of the Venue, and/or their respective authorised representatives;
    7. the "Event" means the match, event or ceremony to which, as per the face of the Ticket, the Holder is entitled to admission;
    8. "person" shall include natural and juristic persons;
    9. "Ticket" means a ticket issued by Management in respect of an Event;
    10. "Ticket Refund Policy" means the policy adopted by Management for the refund of a Ticket as published on the Website(s) or otherwise made available to the Holder;
    11. "Tournament" means ICC World Twenty20 England 2009;
    12. "Tournament Partners" means official sponsors, official suppliers, broadcasters and other parties commercially associated with the Tournament in terms of a valid and binding agreement with Management;
    13. "Venue" means the venue at which the Event takes place (and includes any area within the magnetometers or secured perimeter access to which is under the control of Management); and
    14. "Website(s)" means the website www.icc-cricket.com and any other official website established by ICC for the Tournament;
 

2) Each and every Holder is deemed to have agreed to these Conditions. The Applicant is responsible for ensuring that any subsequent Holder complies with these Conditions and the Applicant is responsible for any subsequent Holder's failure to comply with these Conditions. The Applicant shall be deemed to have made any Holder expressly aware of these Conditions. By their use of the Ticket the Holder expressly acknowledges that he/she has been made aware of these Conditions and undertakes to comply herewith. The Holder, in agreeing to these Conditions, also agrees to be bound by the Tournament Ticket Refund Policy. There shall be no Tournament Ticket Refund Policy until such time as it is posted on the Website(s) or otherwise made available to the Holder. THE HOLDER MUST READ THESE CONDITIONS AND THE TOURNAMENT TICKET REFUND POLICY CAREFULLY AND MAY NOT MAKE PAYMENT FOR, PURCHASE, HOLD OR USE THE TICKET OR ENTER (OR ATTEMPT TO ENTER) THE VENUE IF HE/SHE DOES NOT UNDERSTAND AND AGREE TO THESE CONDITIONS AND THE TOURNAMENT TICKET REFUND POLICY. For the purposes of these Conditions, making use of/using the Ticket shall include, without limitation, accepting the Ticket from any person, presenting the Ticket to Tournament personnel outside the Venue; presenting the Ticket for entry to the Venue; and utilising the Ticket in conjunction with or as part of a travel package or hospitality package.

3) Possession of the Ticket confers a right on the Holder to be permitted admission to the Venue and to view the Event from the seat or area specified on the Ticket. The Holder shall only be admitted into the Venue on presentation of the whole Ticket, which is not defaced or damaged in any way. The Ticket entitles only 1 (one) person entry into the Venue for the duration of the Event. In allowing the Holder entry to the Venue, Management relies on the Holder's acceptance of and agreement to these Conditions. The Ticket and entry to the Venue are subject to these Conditions, no matter how the Ticket is purchased, obtained or used.
4) Right of admission is reserved at the reasonable discretion of Management. Where admission is refused or the Holder is evicted from the Venue and/or demarcated areas for a breach of these Conditions, it shall be within the reasonable discretion of Management to refund any amount paid by the Applicant in respect of any Ticket.
5)
The Ticket will be valid until the Event has been completed or is reasonably deemed by Management to have been completed. The Ticket may not be exchanged or used for any Event other than that indicated thereon. Except as otherwise provided in the Ticket Refund Policy, if the Event is cancelled or curtailed due to adverse weather conditions, there shall be no obligation on Management to reschedule the Event.

The Ticket shall only be purchased or obtained through agents specifically authorised by Management for that purpose. A list of official authorised agents will be made available on the Website(s), and no Ticket sold by any agent not named on that list shall be valid.
7)
The Ticket is and remains at all times the property of IDI.
8) The Holder shall not:-

A. use, offer or apply the Ticket in any manner not specified in these Conditions, such as, without limitation, as a prize or in any other manner in a lottery or competition;
B use, offer or apply the Ticket for any promotional, advertising or commercial purpose; or
C sell, donate, transfer or in any way dispose of the Ticket to any person/entity for the purpose of commercial gain nor sell the Ticket except as expressly permitted by these Conditions.

For the purposes of these Conditions, "commercial gain" includes, without limitation, the receipt or accrual of any benefit (whether financial, in kind or otherwise) obtained as a result of any sale, donation, transfer or disposal of the Ticket. The use of the Ticket either alone or as part of a package of other services or products, the offer for sale, sale, donation, transfer or disposal of the Ticket in connection with or in association with any flight or other mode of travel, accommodation, hospitality, meal or beverage, any form of entertainment and/or any product, service or merchandise shall be considered to be for the purposes of commercial gain. Any breach of this condition 8 shall render the Ticket void and the Holder shall lose all rights conferred on him/her by possession of the Ticket, including, without limitation, the right to enter and/or remain in the Venue.

9) The Holder shall not use, alter, copy or otherwise deal with any of the symbols, trade marks, logos and/or intellectual property appearing on the Ticket.
10) Management reserves the right to make alterations to the times, dates and venues of Events or to substitute the seat or area to which the Ticket refers with another at its reasonable discretion. Refunds (if any) shall be paid only at the reasonable discretion of Management and in accordance with the Refund Policy (if any). Management does not guarantee that the Holder will have an uninterrupted and/or uninhibited view of the Event from the seat provided, nor does Management give any warranty as to the quality, content or duration of the Event.
11)
Applicants may purchase Tickets only for their own personal use and that of their Guests. Each Applicant shall retain at least 1 (one) Ticket for his/her personal use and may only transfer the remaining Tickets to his/her Guests for their personal use once, for no greater than the face value of the Ticket and any pro-rated booking fee, and not for commercial gain. Except for the permitted transfer from Applicant to Guest set out above in this condition 11, neither an Applicant nor any Guest may sell, offer for sale, auction by any means (whether alone or with other items), re-sell or transfer a Ticket without the prior written approval of Management. Except as permitted by this condition 11 an Applicant may not purchase any Ticket as agent for any other person. The benefit conferred by the Ticket is personal to the Applicant or Guest and not assignable or otherwise transferable, except as expressly permitted by these Conditions. The rights given in condition 3 may only be exercised by the Applicant and their Guests.
12) If requested by Management the Applicant must provide details (including the names) of his Guests and Management may require proof of identity from the Holder as a precondition to the Holder's being permitted to exercise any rights accorded by the Ticket.
13) If requested by Management, the Holder must produce the entire Ticket. Management reserves the right to refuse admission or eject from the Venue without refund any Holder who, in the reasonable opinion of Management:-

A does not produce a valid Ticket on request;
B is in breach of any of these Conditions;
C. may (i) unreasonably obstruct the viewing of other spectators and/or (ii) be a source of danger, nuisance, or annoyance or otherwise give rise to concerns in relation to the safety and security arrangements for the Event. (This includes, without limitation, public nudity or indecency, interference with the conduct of any Event, excessive noise; the use of foul, obscene, abusive, sexist or racist language; the wearing or other display of commercial, political or offensive signage or logos; the throwing of any object that might injure or cause damage to people or property; or engaging in any conduct with, acting towards, or speaking to any player, umpire, referee or other official or other person in a manner which offends, insults, humiliates, intimidates, threatens, disparages or vilifies that other person on the basis of that other person's race, sex, religion, colour, descent or national or ethnic origin);
D fails to comply with instructions from a police officer or security officer;
E. is in possession of narcotics (other than those prescribed by a registered medical practitioner) or alcoholic beverages when entering the Venue or who appears to be under the influence of drugs and/or intoxicated;
F. is in possession of (i) any article that may be used or may be expected to be used as a weapon or missile or that is deemed or considered by Management to be dangerous (which includes, without limitation, any firearm, knife, explosive , firework, flare, incendiary device or mace; (ii) gas cylinders including portable barbeque equipment (iii) musical instruments, megaphones and compressed air or gas operated horns; (iv) banners which could restrict the view of, or be construed by Management as offensive to, other spectators; (v) banners, placards, leaflets, signs, objects or clothing containing political, promotional or commercial identification or messages in breach of condition 18; (vi) any other objects or item which may be deemed by Management to be offensive, disruptive, dangerous or likely to infringe any party's rights or any party's safety or security; (vii) any dangerous article or substance not referred to above; or (vii) any item listed on the list of prohibited items displayed at the Venue or on the Website(s);
G. is suspected of committing, or being likely to commit, or having committed a criminal offence within the Venue;
H. enters any area at the Venue which he/she may be prohibited by Management to enter; or
I. damages, interferes with or tampers with any property of Management.

14) Management reserves the right to search the Holder (including a search of his/her bags, clothes and other possessions) prior to entry into the Venue. Should the Holder refuse to be searched in accordance with this condition 14, Management reserves the right to refuse admission or eject him/her from the Venue without refund.
15) Should the Holder be ejected from the Venue under conditions 13 or 14, all further rights of entry for the Event shall be rendered void and Management shall be entitled, at its reasonable discretion, to render void the Holder's further rights of entry for all other Events forming part of, or connected with the Tournament.
16) Should the Holder be in possession of any of the items listed in conditions 13.c, 13.e or 13.f, Management shall be entitled to seize such items (without liability) from the Holder without obligation to return such items to the Holder, or to compensate the Holder in respect thereof.
17) No alcohol may be brought into or taken out of the Venue, with the exception of Event match-days held at Lord's Cricket Ground, where it shall be permitted subject to MCC's own restrictions in this regard. The consumption of alcohol is permitted only in the bars or other authorised areas or places in the Venue during hours determined by Management, which reserves the right to close or restrict entry to any such bars or authorised areas at any time. In addition to these terms and conditions, entry to a Venue shall be subject to any applicable ground regulations specific to that Venue. Such ground regulations shall be displayed publicly outside the Venue itself.
18) The Holder shall not engage in any form of Ambush Marketing and shall not conduct any activity that conflicts with, impairs, infringes or denigrates the rights of any Tournament Partner. The Holder shall not be entitled, in or around the Venue, to conduct, carry out or cause to be conducted or carried out any promotions, advertising or marketing or other commercial activity, unless same has been expressly authorised by Management in advance.
19) The Holder shall not, within the Venue, (i) offer any goods or services (including, without limitation, newspapers, periodicals, drinks or food) for sale or (ii) distribute or give away or attempt to distribute or give away any free items or any political, religious, charitable, commercial, advertising or promotional material or other documents.
20) The Holder shall not:-

A. enter any playing field, the players' dressing room, players' practice areas or other players' areas without the consent of IDI/Management;
B. obstruct any gangway, access-way, exit, entrance or staircase;
C. congregate with other persons in any area not specifically designated by Management for that purpose;
D. smoke in any areas that is not designated as a smoking area;
E. seek entry to stands or seats for which the Holder does not hold a valid Ticket;
F. climb walls, fences, stands or any other structures in the Venue;
G. deface or obscure any notice or advertisement; or
H. enter any area for which accreditation is required or which is designated as an area to which members of the public are not admitted.

21) The Holder shall not, except for personal and private non-commercial purposes, and in any event not for commercial gain, make or use, broadcast, narrowcast, telecast, transmit, publish, disseminate, reproduce or circulate by any means (including, without limitation, utilising television, radio, satellite, the internet, or any wireless service), any recordings, audio, video, photograph, text, data, images, statistics, results, commentary or any other information relating to the Event. All copyright of any of the aforementioned materials is acknowledged as belonging to IDI.
22)
In respect of their attendance at the Tournament the Holder irrevocably and unconditionally consents without compensation to the recording, transmission and use of his/her likeness and/or voice by any means (including, without limitation, audio and visual recordings by television cameras and photographers) throughout the world, to the fullest extent possible in perpetuity, by Management and/or Tournament Partners and/or any licensee or assignee thereof.
23) To the extent that Management is prevented or delayed by matters beyond its reasonable control from performing any of its obligations under these Conditions, Management shall be relieved of liability to any Holder for failure to perform or for delay in performing such obligations.
24) To the extent permitted by applicable law, Management shall not be liable to any Holder for any loss or damage sustained by the Holder, including, but not limited to: (i) death or personal injury to any person (ii) loss of, or damage to property, (iii) loss of profit (iv) loss of business or opportunity, (v) indirect or consequential loss or (vi) special damages, howsoever caused, which arises out of or in connection with the Tournament (including, without limitation, arising as a result of the cancellation, postponement or relocation of any Event or any Holder's entry to or attendance at the Venue), notwithstanding that same may have been caused by a negligent act or omission on the part of any of Management.
25)
Each of the provisions set out in these Conditions shall be severally enforceable. Notwithstanding that the whole or any part of these Conditions may prove to be unenforceable, the other provisions of these Conditions and the remainder of the provision in question shall continue in full force and effect.
26)
The Holder irrevocably and unconditionally consents to the collection, use and insertion into a database by Management of personal information provided by the Applicant and the Holder for the purposes of implementation of these Conditions. Management may share such personal information as may be generally and reasonably required for the proper and efficient staging of the Tournament and to give effect to any of its rights in terms of these Conditions.
27) Spectators are reminded that racially abusive comments and actions will result in ejection from the ground and possible further action such as criminal prosecution, identification by way of photographing and/or capturing by video camera of the images of such persons and life-bans being imposed on such persons.
28) These Conditions are governed by laws of England and the Applicant and the Holder irrevocably submit to the non exclusive jurisdiction of the English courts.
